BaySpeed Terms of Service

Short Version

BaySpeed is an independent iOS app that estimates ball speed and shot physics from your own Topgolf game history. It's provided as-is, the speed figures are estimates (not launch-monitor measurements), and it's not affiliated with Topgolf. By using the app you agree to the terms below. If you don't agree, please don't use BaySpeed.

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your use of the BaySpeed app ("BaySpeed", "the app", "we", "us"), developed by Kevin Tang. By downloading, installing, or using BaySpeed, you agree to these Terms and to our Privacy Policy. Your use of the app is also subject to Apple's standard Licensed Application End User License Agreement (EULA); where these Terms and Apple's EULA conflict, Apple's EULA controls for the app license itself.

2. What BaySpeed Does

BaySpeed lets you sign in with your own Topgolf account, imports your game history, and analyzes each shot to estimate ball speed, launch angle, carry vs. roll, kinetic energy, and impact force. It does this with a physics simulation (Newtonian trajectory with drag, Magnus lift, and spin decay) that infers the ball speed consistent with the yardage Topgolf recorded.

3. Estimates, Not Measurements

BaySpeed's outputs are estimates, typically within roughly ±10–15% of true values, derived from data Topgolf already recorded for your shots. BaySpeed is not a launch monitor and does not measure your swing with sensors or radar. Do not rely on its figures for coaching decisions, wagering, equipment fitting, or any other purpose requiring measured accuracy.

4. Your Topgolf Account and Responsibilities

• You must have your own valid Topgolf account, and you may use BaySpeed only to access your own game data.
• You are responsible for complying with Topgolf's own terms of service and any applicable laws when using your Topgolf account.
• You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use BaySpeed.
• You agree not to use BaySpeed to access, scrape, or analyze data belonging to anyone other than yourself.

5. Not Affiliated With Topgolf

BaySpeed is an independent third-party app. It is not affiliated with, sponsored by, authorized by, or endorsed by Topgolf. "Topgolf"® and "Toptracer"® are trademarks of their respective owners and are used here only nominatively to describe what the app works with. All rights to those marks belong to their owners.

6. Purchases (BaySpeed Pro)

• BaySpeed is free to download. An optional one-time, non-consumable in-app purchase, "BaySpeed Pro" ($6.99 USD, price may vary by region and over time), unlocks additional features. There is no subscription.
• All purchases are processed by Apple through the App Store. We never receive or handle your payment information.
• Refunds are handled by Apple under its standard policies. Requests should be made to Apple via reportaproblem.apple.com; we cannot issue App Store refunds directly.
• Purchases restore via your Apple Account on devices where you are signed in.

7. Acceptable Use

You agree not to: reverse engineer, decompile, or disassemble the app except to the extent permitted by law; use the app to break any law or to violate any third party's rights or terms; interfere with or disrupt the app or its connected services; or resell, redistribute, or commercially exploit the app or its outputs without permission.

8. Intellectual Property

BaySpeed, including its design, code, and physics methodology, is owned by Kevin Tang and protected by applicable intellectual-property laws. These Terms grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for your own non-commercial purposes. The data fetched from your Topgolf account remains yours.

9. Disclaimer of Warranties

BaySpeed is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that its estimates will be accurate. BaySpeed depends on Topgolf's API, which may change or become unavailable at any time, potentially affecting or disabling features.

10. Limitation of Liability

To the maximum extent permitted by law, Kevin Tang shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of (or inability to use) BaySpeed. Our total aggregate liability for any claim relating to the app will not exceed the amount you paid for the app (if any) in the twelve months preceding the claim.

11. Changes To These Terms

We may update these Terms from time to time. The current version will always be published at this URL with an updated effective date. Material changes may also be noted in an app update's release notes. Continued use of the app after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules, except where superseded by Apple's EULA or by mandatory consumer-protection laws of your place of residence.
